The Guyana Revenue Authority (GRA) wishes to notify the general public of the criteria to be satisfied upon application for sufferance wharf.
According to Section 2 of the Customs Act Chapter 82:01, “sufferance wharf means any place other than an approved place of loading or unloading at which the Commissioner-General may, in his discretion, and under such conditions and in such manner as he may direct, either generally or in any particular case, allow any goods to be loaded or unloaded.”
CRITERIA FOR GENERAL SUFFERANCE APPLICANTS:
- Written application to the Comptroller or Commissioner-General.
- An approved plan of the premises showing washrooms, storage & office areas. (In the case of non-land Sufferance areas, the specific nautical specifications of key loading and discharge points).
- Approved Building Certificate and/or No-Objection from Central Housing & Planning Authority or Government Regulatory body including; Maritime Administration Department (MARAD); Lands & Surveys; Environmental Protection Agency (EPA); Regional or Neighbouring Democratic Councils or Municipality where applicable.
- A Certificate of approval or No-Objection from the Guyana Fire Service (Original).
- Proof of ownership or legitimate occupancy of the (If the applicant is not the owner of the premises, a valid lease or tenancy agreement showing occupancy for a minimum of five (5) years.)
- A copy of the Business Registration for the establishment.
- A written proposal outlining the main purpose and nature of planned activities related to goods to be loaded or off loaded monthly over the upcoming 12 Months.
- A list of the estimated value and description of the goods to be stored if applicable.
- The proposed Guarantor’s name and address as well as indication of Value of Taxes for guarantee concerning Financial Bonds as follow:
- General Export Bond (C53)
- General Transshipment Bond (C56)
- General Bonds for Security of Taxes on Goods Held in a Customs Area (C61)
- Other temporary importation bonds where applicable.
- A statement of the security arrangement to be put in place.
CRITERIA FOR CASE-BY-CASE SUFFERANCE APPLICANTS:
- Written application to the Comptroller or Commissioner-General seeking permission and clearly stating the reason(s) for the request including the proposed time schedule for completion of work.
- Submit reference and copy of the declaration(s) and supporting documents whether import/export.
